NEWS Community Registered Designs System Imminent
The Office for Harmonization in the Internal
Market (OHIM) has announced that it intends to start handling
applications for Community designs on 1 April 2003. In fact, it
will be possible to submit a Community design application from 1
January 2003, but its official filing date will not be earlier than 1
April. Importantly, this means that a national design application
filed on 1 October 2002 or later can serve as a priority application
for a Community design. The purpose of the community design is to provide
a single design registration that is effective throughout the European
Union that will run in parallel with existing national systems.
In this respect, it is much like the hughely successful
Community Trade Mark. The fee structure makes Community designs very
attractive. The cost of an application to cover the entire EU is
likely to be less than the cost of any two national applications.
